The purpose of this Privacy Policy is to determine the terms and conditions regarding the use of personal data shared with APCON by Platform users/members/visitors (“Data Owner”) or generated by APCON during the operation of the www.apcon.com.tr website (“Site”) and mobile application (collectively referred to as the “Platform”) operated by APCON İNŞAAT YAPI SANAYİ VE TİC. A.Ş. (“APCON”).

The Data Owner declares that he/she has been informed about the processing of his/her personal data with this Privacy Policy and that he/she consents to the use of his/her personal data as specified herein.

Under this heading, the data processed by APCON and considered as personal data in accordance with the Personal Data Protection Law are listed. Pursuant to Articles 3 and 7 of the Law on the Protection of Personal Data, data that are irreversibly anonymized will not be considered as personal data in accordance with the provisions of the aforementioned law and processing activities related to this data will be carried out without being bound by the provisions of this Privacy Policy.

 

For which purposes is the data used?

APCON may process the personal data provided by the Data Owner for the purposes of planning and execution of the activities necessary for recommending and promoting the services offered by APCON to the relevant persons by customizing them according to the tastes, usage habits and needs of the relevant persons, carrying out the necessary work by the business units to benefit the relevant persons from the services offered by APCON and carrying out the relevant business processes, planning and execution of APCON’s business strategies.

APCON may process and share personal data with third parties in accordance with Articles 5 and 8 of the Law on the Protection of Personal Data and/or in the presence of exceptions in the relevant legislation without obtaining the separate consent of the Data Owner. The main ones of these situations are stated below:

It is mandatory for the protection of the life or physical integrity of the person who is unable to disclose his/her consent due to actual impossibility or whose consent is not legally valid,

It is necessary to process personal data, provided that it is directly related to the establishment or performance of any contract between the Data Subject and APCON,

It is mandatory for APCON to fulfill its legal obligations,

It has been made public by the Data Subject himself/herself,

Data processing is mandatory for the establishment, exercise or protection of a right,

Provided that it does not harm the fundamental rights and freedoms of the Data Owner, it is mandatory to process data for the legitimate interests of APCON.

 

Who can access the data?

APCON may transfer the personal data belonging to the Data Owner and the new data obtained by using this personal data to third parties from whom APCON’s services are used in order to achieve the purposes specified in this Privacy Policy, limited to the purpose of providing such services. APCON may also transfer the data to APCON’s business partners and suppliers and legally authorized institutions and organizations within the scope of the purposes specified in this Privacy Policy.

APCON may share with third parties such as outsourcing service providers, hosting service providers (hosting services), law offices, research companies, call centers, including those who send SMS in order to improve the Data Owner experience (including improvement and personalization), to ensure the security of the Data Owner, to detect fraudulent or unauthorized use, to investigate operational evaluation, to eliminate errors regarding Platform services and to achieve any of the purposes set out in this Privacy Policy.

The Data Owner agrees that the aforementioned third parties may store the personal data of the Data Owner on their servers anywhere in the world, provided that it is limited to the above-mentioned purposes, and that it consents to this in advance.

 

On the Right of Access to Data and Correction Requests

Data subjects pursuant to Article 11 of the Law,

Learn whether personal data is being processed,

Request information if their personal data has been processed,

To learn the purpose of processing personal data and whether they are used for their intended purpose,

To know the third parties to whom personal data is transferred domestically or abroad,

To request correction of personal data in case of incomplete or incorrect processing and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,

Although it has been processed in accordance with the provisions of the Law and other relevant laws, to request the deletion or destruction of personal data in the event that the reasons requiring its processing disappear and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,

To object to the emergence of a result to the detriment of the person himself/herself by analyzing the processed data exclusively through automated systems,

In case of damage due to unlawful processing of personal data, it has the right to demand compensation for the damage.

These rights will be evaluated and finalized within 30 (thirty) days if they are communicated by the personal data owners by the methods specified in the APCON İNŞAAT YAPI SANAYİ VE TİC. A.Ş. Personal Data Protection and Processing Policy at www.apcon.com.tr/kvkk.html. While it is essential not to charge any fee for the requests, APCON reserves the right to charge a fee over the fee tariff determined by the Personal Data Protection Board.

The Data Owner undertakes that the information subject to this Privacy Policy is complete, accurate and up-to-date, and that it will update them immediately in case of any changes in this information. APCON will not have any responsibility if the Data Owner has not provided up-to-date information.

The Data Owner accepts that he/she may not be able to fully benefit from the operation of the Platform if he/she makes a request that will result in the inability to use any of his/her personal data by APCON and declares that he/she will bear all kinds of responsibility arising in this context.

 

Retention Period of Personal Data

APCON will retain the personal data provided by the Data Owner for the period required by the above-mentioned processing purposes.

In addition, APCON will be able to store personal data in the event of any dispute that may arise between the Data Owner and the Data Owner, limited to the purpose of realizing the necessary defenses within the scope of the dispute and for the statute of limitations determined in accordance with the relevant legislation.

 

Data Security Measures and Commitments

APCON, in the conditions specified in the relevant legislation or expressed in this Privacy Policy,

That personal data is not processed unlawfully,

To prevent unlawful access to personal data and to protect personal data

It undertakes to take the necessary technical and administrative measures to ensure the appropriate level of security and to have the necessary audits carried out.

APCON cannot disclose the personal data obtained about the Data Owner to anyone else in violation of the provisions of this Privacy Policy and the Law on the Protection of Personal Data and cannot use it for purposes other than processing.

In case of linking to other applications through the Platform, APCON does not bear any responsibility for the privacy policies and contents of the applications.

Changes to Privacy Policy

APCON may change the provisions of this Privacy Policy at any time. The updated Privacy Policy comes into force on the date it is presented to the Data Owner through any method.
